L1 Visa for United States

Intra company Transfer Visa for USA - Leading towards Green Card

Overview of the L1 Visa

The L1 Visa is a non-immigrant visa that allows companies to transfer employees from their foreign offices to their U.S.-based offices. This visa is ideal for international businesses expanding into the U.S. market, allowing for smooth employee relocation while ensuring continuity of operations and knowledge transfer. The L1 Visa can be granted to managers, executives (L1A Visa), or specialized knowledge employees (L1B Visa), with pathways to permanent residency.

At Superior Consulting, we are dedicated to assisting you throughout the L1 Visa process, providing guidance to streamline each step of your application and maximize your chance for approval.

Types of L1 Visa

L1A Visa

This visa is specifically for executives and managers, enabling them to work in the U.S. for up to 7 years. It is also the ideal choice if you wish to pursue permanent residency, as L1A Visa holders often qualify for an EB-1C green card.

L1B Visa

The L1B Visa is designed for employees with specialized knowledge essential to the company's operations. This visa allows employees to work in the U.S. for up to 5 years. Specialized knowledge may include proprietary techniques, systems, or products specific to the company.

L1 Visa Eligibility Criteria

To qualify for an L1 Visa, you and your employer must meet the following criteria:

  1. Employer Requirements

    • The employer must have a qualifying relationship with a foreign company. This can include a parent company, subsidiary, affiliate, or branch office.

    • The employer must currently be, or have plans to be, doing business as an employer in the U.S. and at least one other country.

  2. Employee Requirements

    • The employee must have worked for the foreign company for at least one continuous year within the last three years before applying.

    • The employee must be seeking entry to the U.S. to work in a managerial, executive, or specialized knowledge capacity.

L1 Visa Benefits

  • Dual Intent: The L1 Visa allows for dual intent, meaning applicants can pursue permanent residency without affecting their non-immigrant visa status.

  • Family Accompaniment: L1 Visa holders can bring their spouse and children under 21 with them to the U.S. on an L2 Visa. Spouses may apply for employment authorization.

  • Flexibility for Business Growth: Companies have the flexibility to expand their operations into the U.S., with employees legally authorized to work in critical roles.

L1 Visa Application Process

  1. Determine Eligibility: Confirm the qualifications for the employer, employee, and U.S. entity.

  2. Complete Form I-129: The U.S. employer files Form I-129 (Petition for a Nonimmigrant Worker) with the U.S. Citizenship and Immigration Services (USCIS).

  3. USCIS Approval: Once approved, the employer receives a Notice of Action (Form I-797) from USCIS.

  4. Consular Processing (If Applicable): For applicants outside the U.S., schedule a visa interview at a U.S. consulate or embassy.

  5. Attend Visa Interview: The employee attends an interview, bringing required documentation, including approval notice and proof of company relationship.

  6. Receive Visa Decision: After the interview, the consulate will issue a visa decision. Approved candidates can begin their journey to the U.S. and commence work in the designated role.

L1 Visa Processing Time and Fees

  • Processing Time: Processing times vary based on workload and consular processing requirements. Standard times range from 2-6 months. Premium processing is available for an additional fee, with decisions within 15 days.
